Introduction
These Terms & Conditions govern the use of the Gentle Fig Nutrition website and any services provided by Gentle Fig Nutrition.
By using this website or purchasing services, you agree to these Terms & Conditions.
Services
Gentle Fig Nutrition provides evidence-based nutrition support, dietary analysis and nutrition education.
Services may include dietary analysis, personalised recommendations, educational resources and ongoing nutrition support, depending on the package selected.
Payment
Payment must be made in full before services are provided unless otherwise agreed in writing.
Prices may be updated from time to time and will be clearly displayed before purchase.
Tier 1 – Self-Guided Nutritional Analysis
Tier 1 provides access to dietary analysis through MyFood24 without personalised nutrition advice or feedback.
Your subscription can be cancelled at any time. Cancellation will stop future recurring payments but will not result in a refund for any payment already made.
Once cancelled, you will continue to have access to your MyFood24 account and all Tier 1 features until the end of your current paid billing period. Access will then end automatically unless your subscription is renewed.
No partial refunds or credits will be issued for unused time remaining within your current billing period.
Upon cancellation, your data may be permanently deleted from the platform unless you request data retention before your subscription ends. Requests for data retention must be made in writing before cancellation takes effect.
Tier 2 – One-Off Dietary Analysis
Tier 2 includes dietary analysis and personalised nutrition recommendations based on the information you provide.
Consultation time will not be used to enter dietary intake data into MyFood24 retrospectively.
Where included, consultations may last up to 60 minutes but will not be extended beyond the allocated appointment time.
Completed dietary analysis reports will normally be delivered within 7 days of receiving sufficient dietary data and any required supporting information.
Tier 3 – Ongoing Nutrition Support
Tier 3 is provided on a minimum 3-month commitment basis to allow sufficient time for meaningful support, implementation and review.
Following the initial 3-month period, the service continues on a rolling monthly basis and may be cancelled with 30 days' notice.
Between scheduled appointments, reasonable email or WhatsApp support (where included within your package) is intended for brief questions, clarification and accountability. It should not be relied upon for urgent medical advice or unlimited consultations. Gentle Fig Nutrition aims to respond within two working days, although response times may vary.
Appointments and Cancellations
If appointments are included within your service package, at least 24 hours' notice is requested for cancellations or rescheduling.
Gentle Fig Nutrition reserves the right to reschedule appointments where necessary.
Repeated missed or late-cancelled appointments may result in the loss of that appointment without a refund.
Client Responsibilities
You agree to provide accurate, complete and honest information relevant to the services being provided and to notify Gentle Fig Nutrition of any significant changes that may affect the advice provided.
Recommendations are based on the information supplied and may be affected if information is incomplete, inaccurate or misleading.
You remain responsible for the decisions you make regarding your diet, lifestyle and health.
Results
While recommendations are based on current evidence and professional practice, no guarantees can be made regarding specific health outcomes, weight loss, behaviour change or other results.
The quality, accuracy and usefulness of any nutritional analysis, written report or recommendations provided by Gentle Fig Nutrition are dependent upon the accuracy and completeness of the information entered into MyFood24 by the client.
Clients are responsible for ensuring that food and drink intake is recorded as accurately and honestly as possible, including portion sizes, recipes, ingredients and relevant beverages where applicable.
Gentle Fig Nutrition cannot accept responsibility for inaccurate, incomplete or misleading reports or recommendations where these arise from incomplete, inaccurate or omitted information entered by the client.
The more complete and accurate your food diary, the more personalised and valuable your nutritional analysis will be.
Medical Disclaimer
Gentle Fig Nutrition does not provide medical diagnosis, treatment or prescription services.
Any medical concerns should be discussed with your GP or appropriate healthcare professional.
Nutrition support is not a substitute for medical advice, diagnosis or treatment.
Referral and Scope of Practice
Gentle Fig Nutrition reserves the right to decline, pause or terminate services where a client's needs fall outside the reasonable scope of practice of a Registered Associate Nutritionist (ANutr).
Where appropriate, clients may be advised to seek support from their GP, registered dietitian, specialist healthcare professional or other relevant service before continuing.
Where services are terminated for this reason, any refund or credit will be considered on a case-by-case basis, taking into account the work already completed.
Age Requirements
Services are intended for individuals aged 18 years and over unless otherwise agreed in writing. Where services are provided to a child or young person, a parent or legal guardian must provide consent and remain responsible for the information supplied.
Client Engagement
Where information, questionnaires, food diary entries or other required materials are not provided within a reasonable timeframe, Gentle Fig Nutrition reserves the right to close the case and consider the service complete. No refund will be provided for services already commenced.
Client dietary data may be stored securely within MyFood24 for the purposes of delivering the purchased service and in accordance with the Gentle Fig Nutrition Privacy Policy.
Intellectual Property
All content, reports, resources and materials provided by Gentle Fig Nutrition remain the intellectual property of Gentle Fig Nutrition unless otherwise stated.
They may not be reproduced, distributed, shared, sold or published without permission.
Limitation of Liability
Gentle Fig Nutrition provides evidence-based nutrition information, dietary analysis and personalised nutrition support based on the information provided by the client.
While every effort is made to ensure that information and recommendations are accurate, current and appropriate, Gentle Fig Nutrition cannot guarantee specific outcomes, results or health improvements.
Gentle Fig Nutrition shall not be held responsible for any loss, injury, damage or adverse outcome arising from reliance on information, recommendations or services provided, except where liability cannot legally be excluded.
Nothing in these Terms & Conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded under applicable law.
Governing Law
These Terms & Conditions shall be governed by and interpreted in accordance with the laws of England and Wales.
Any disputes arising in connection with these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Right to Refuse Service
Gentle Fig Nutrition reserves the right to decline or discontinue services where it is considered inappropriate, unsafe, unethical, outside the practitioner's competence, or where a productive professional relationship cannot reasonably be maintained.
